Terms of Service
These Terms govern your use of Nanopress. Section 6 ("Advertising") applies if you purchase ad placements. Please read these Terms carefully.
1. Who we are; acceptance
Nanopress is operated by Opus Noma LLC ("Opus Noma," "we," "us"). By subscribing to our newsletter, advertising with us, or otherwise using our websites and emails (together, the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
2. The newsletter
Nanopress compiles local news and events from publicly available sources using automated and artificial-intelligence tools, and delivers them by email. We work to make the newsletter accurate and useful, but we do not warrant that it is complete, error-free, or current, and it is provided for general information only. It is not professional, legal, financial, or other advice. Always verify important details with the original source.
3. Eligibility and your account
You must be at least 18 years old, or the age of majority where you live, to use the Service. We use a one-time email code instead of a password; you are responsible for keeping access to your email account secure and for activity that occurs through it. You may unsubscribe at any time using the link in any edition or at nanopress.net/manage.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- attempt to disrupt or gain unauthorized access to the Service or its systems;
- scrape, harvest, or resell its contents except as expressly permitted; or
- impersonate others or misrepresent your affiliation.
5. Content and intellectual property
The newsletter's selection, arrangement, and original text are owned by Opus Noma. Headlines, summaries, links, and other materials that originate from third-party sources remain the property of their respective owners; we provide links so you can read the original reporting. "Nanopress" and our logo are our trademarks. You may share links to our editions and landing pages.
6. Advertising
This section applies if you purchase advertising placements through the Nanopress advertiser portal.
- Placements and pricing. You may purchase placements in specific editions at the rates shown at the time of booking. Charges are processed through Stripe, and by booking you authorize the charge.
- Ad content standards. Ads must be about the local area you select, lawful, family-friendly, and honest (no misleading or deceptive claims). You represent that you have the rights to the content you submit and that it complies with applicable law, including advertising and consumer-protection rules.
- Review and removal. We review ads before they run and may reject, change the placement of, or remove any ad at our sole discretion, including after it has been approved. If we remove an ad that has not run because it violates these Terms, we may withhold the corresponding fee.
- Cancellations and refunds. You may cancel a placement and receive a refund up to the cutoff stated at the time of booking. After that cutoff, the placement is non-refundable. Refunds are returned through Stripe to your original payment method.
- No guarantee of results. We do not guarantee any particular number of impressions, opens, clicks, or business results from an ad.
- Your responsibility. You are solely responsible for your ad content and will indemnify us as described in Section 9 for claims arising from it.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
8. Limitation of liability
To the fullest extent permitted by law, Opus Noma will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred U.S. dollars ($100).
9. Indemnification
You agree to indemnify and hold harmless Opus Noma from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your ad content, or your violation of these Terms or of any law or third-party right.
10. Termination
We may suspend or end your access to the Service at any time if you violate these Terms or to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 5, 7, 8, and 9) will survive.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Massachusetts will have exclusive jurisdiction over any dispute relating to these Terms or the Service.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
