SJC Rejects Marshfield's MBTA Communities Act Challenge
The Supreme Judicial Court on Sept. 18 denied Marshfield's challenge to the MBTA Communities Act, affirming that compliance with G.L. c. 40A, §3A is mandatory. Writing for the court, Justice Serge Georges Jr. rejected Marshfield's arguments that the law is an unfunded local mandate and that it violates town meeting voting rights, the Home Rule Amendment and the Zoning Act. Marblehead remains in interim compliance while its own district plan awaits state review.
