SJC clears White Stadium construction

The Massachusetts Supreme Judicial Court on Wednesday threw out a lawsuit challenging the new White Stadium in Franklin Park, allowing construction to continue. The court found that while the stadium parcel was originally taken by eminent domain for park use, legislative action in 1947 and 1950 dedicated it to another use not covered by Article 97, which governs the reuse of parkland. That provision would otherwise have required a two-thirds vote of the state legislature to build the 10,000-seat stadium.
